On January 19, 2021, President Trump issued a Memorandum directing the Secretary of Homeland Security (“DHS”) whereby he directed the Secretary to take appropriate measures to implement Deferred Enforced Departure (DED) for Certain Venezuelans.
On March 9, 2021, the Biden Administration issued a new Executive Order where it was that the conditions within Venezuela, presents an ongoing national security threat to the safety and well-being of the Americans and this which warrants the deferral of the removal of Venezuelans Nationals who are present in the United States.
In Order to Qualify for DED, you:
- Must be a Venezuelan national or a person without nationality whose last place of habitual residence was Venezuela;
- You must be present in the US as of January 20, 2021;
- And you do not fall within any of the exceptions outlined within the executive order.
Benefits of the DED:
- You will not be removed or deported from the U.S. for 18 months and
- You will qualify for employment authorization/work permit.
If you are a Venezuelan National, or an individual without nationality who last habitually resided in Venezuela, and you are present in the U.S. as of January 20, 2021 and you do not fall within any of the exceptions outlined in the executive order, you will not be removed/deported from the United States for a period of 18 months, through July 20, 2022, and you are eligible to apply for employment authorization (Work Permit).
