On May 21, 2021, the Secretary of Homeland Security (“DHS”) announced a new 18-month designation of Haiti for TPS. With this new designation, Haitian nationals (and individuals without nationality) currently residing in the United States as of May 21, 2021, can file initial applications for TPS, if they meet the eligibility requirements. According to DHS, the designation is due to extraordinary and temporary conditions in Haiti that prevent nationals from returning safely, more specifically, political crisis and human rights abuses, serious security concerns and COVID-19 pandemic’s exacerbation of a dire economic situation and lack of essential services.
WHAT YOU NEED TO KNOW ABOUT THIS NEW TPS DESIGNATION:
It will only apply to individuals residing in the United States as of May 21, 2021;
Those who travel specifically to the U.S. after May 21, 2021, will not be eligible for TPS, and will be repatriated to Haiti;
The TPS protection will be for 18 months, from the date of the publication of the notice in the Federal Register;
Current TPS beneficiaries from Haiti may file a new application for TPS to ensure that they do not lose TPS or experience a gap in coverage;
Current TPS beneficiaries from Haiti may file a new application for TPS to receive TPS for the entire 18-month period.
