On May 25, 2021, the Secretary of Homeland Security (“DHS”) designated Burma for Temporary Protected Status (“TPS”). The designation of Burma for TPS finally comes as a sign of relief and hope for the Burmese nationals currently in the U.S., upon finding that extraordinary and temporary conditions in Burma prevent its citizens from returning safely. This designation does not come as a surprise, since the country has been dealing with non-stop violence since the military coup d’etat and brutal violence against civilians. In addition to the continuous violence, Myanmar is facing a serious economic crisis, with increasing food and fuel prices stemming from the coup.
DHS has granted TPS for 18 months, starting on May 25, 2021, through November 25, 2022. However, Burmese nationals that are interested in applying for TPS need to do it within the 180-day registration period, that is from May 25, 2021, until November 22, 2021, in order to fully benefit from the temporary protection afforded to its beneficiaries.
If you are from Burma and you are currently present in the U.S., you need to know the following things:
The TPS registration period for Burmese nationals, begins on May 25, 2021, and ends on November 22, 2021. That is, you will have 180 days to file your application for TPS. It is extremely important to file your application on or before November 22, 2021. Failure to do so, will have devastating effects in your immigration situation, since there are very limited situations in which USCIS will exercise discretion and allow a late filing.
TPS is available to you if you were born in Burma. Even if you were not born in Burma, you might still benefit from TPS if you last habitually resided in Burma.
You need to demonstrate that you have resided continuously in the U.S. since March 11 ,2021, and that you were physically present in the U.S. on May 25, 2021, to apply for TPS.
TPS protects you from deportation during the duration of the TPS designation for Burma. Individuals who apply for TPS can also apply for an Employment Authorization Document (EAD) concurrently. With the EAD you will be able to work in the U.S. legally and obtain a driver’s license.
